Regarding candidates, suppliers, partners, employees, and collaborators, ARVAD collects the following personal data: identification, professional, professional activity, or accounting data, of individuals or their representatives in the case of legal entities, such as name, nationality, contact, citizen card data, position, functions, professional contacts, and any personal data whose processing is strictly necessary for contract execution or for compliance with legal obligations;
For contact requests, ARVAD collects the following personal data: identification data such as name, email address, phone or mobile number;
For Newsletter subscription, ARVAD collects the following personal data: identification data such as email address;
ARVAD may only process health data if duly mandated for this purpose and only with the data subject’s consent.

LEGAL BASIS AND PURPOSES FOR PROCESSING PERSONAL DATA
The legal bases for processing personal data of candidates, suppliers, partners, employees, and collaborators are contract execution and compliance with legal obligations, as provided for in points b) and c) of Article 6(1) of the GDPR.
The processing of personal data of candidates, suppliers, partners, employees, and collaborators is intended for any purposes directly related to the execution of the respective contracts or compliance with legal obligations, namely recruitment, hiring, contract management, work management, accounting, commercial activity, candidate management, communication, reception of proposals, service provision.
Processing of personal data for purposes other than those mentioned, namely personal data collected through the ARVAD website or as a result of sending emails with contact requests, depends on the data subject’s consent, as provided for in point a) of Article 6(1) of the GDPR.
Processing of personal data collected through the website or ARVAD’s email address is intended to respond to contact requests and other information, send marketing communications such as newsletters, information about events, or other similar activities.
RETENTION OF PERSONAL DATA
ARVAD only retains personal data in a manner that allows the identification of data subjects for the period strictly necessary to achieve the purposes for which they are processed, notwithstanding the need for retention for a longer period for compliance with legal obligations.
Thus, it should be clarified that personal data related to the recruitment and selection of candidates may be retained for the period necessary to fulfill the purpose (for example, if a candidate joins ARVAD projects, their personal data will be processed according to the purpose of human resources management; if not, they may be kept in reserve for future recruitment processes for 1 year, notwithstanding the right of the data subject to request the deletion of their data at any time).
For requests made through the contact form, personal data is deleted after the response to the contact request and, in any case, always after 6 months from the submission of the contact request.
In the case of personal data collected from Newsletter subscriptions, personal data is deleted after 6 months from the date of the unsubscription request.
However, to comply with legal obligations regarding the retention of books, accounting records, and supporting documents, personal data may be retained for archiving purposes for 12 years, as per Article 123(4) of the Corporate Income Tax Code.
RIGHTS OF THE DATA SUBJECT
ARVAD guarantees the user, at any time, the right to access their personal data, as well as to rectify, delete, port, limit, and/or object to the processing.

RIGHT TO BE FORGOTTEN
The data subject has the right to obtain from the controller the erasure of their personal data, which, in turn, is obliged to erase them when one of the following reasons applies:

(ii) the data subject withdraws consent when consent is the legal basis or objects to the processing and there are no overriding legitimate interests justifying its maintenance.
SECURITY IN PERSONAL DATA PROCESSING
ARVAD is committed to implementing all necessary precautions to preserve the confidentiality and security of collected and processed personal data. Accordingly, technical and organizational security measures have been developed, especially regarding information systems.
ARVAD informs that these security measures are reviewed and updated according to the needs and requirements of these matters.
If, for any reason, a security breach occurs that accidentally or unlawfully causes the destruction, loss, alteration, unauthorized disclosure of, or access to personal data, ARVAD commits to reporting to the National Data Protection Commission, without undue delay and, where possible, within 72 hours after becoming aware of such an occurrence. ARVAD also commits to informing the data subject of the data breach, in accordance with applicable legislation. TRANSMISSION AND COMMUNICATION OF PERSONAL DATA TO THIRD PARTIES
ARVAD only transmits personal data to third parties when necessary to promote scientific, technical, cultural, educational, commercial, and business cooperation or to comply with legal obligations to which ARVAD is subject, chosen based on high standards and bound to comply with applicable legal norms regarding personal data protection.
Such transmission, when due for the fulfillment of its social purpose or legal obligations to which ARVAD is subject or due to the consent of the data subject, is made by limiting the transmitted data to what is strictly necessary to comply with such obligations and through appropriate security measures.
